LIMITED WARRANTY
White Drive Products warrants to Customer that the products(s) sold by White Drive Products shall be free from defects in material and workmanship for a period not to exceed the earlier of four (4) years from date of manufacture or the expiration of the Manufacture’s warranty with respect to any goods in which White Drive Products’ product(s) are installed. The foregoing limited warranty is exclusive; White Drive Products makes no implied warranty of merchantability or implied warranty of fitness for any particular purpose, and no other warranties, expressed or implied, concerning its products. White Drive Products’ limited warranty hereunder cannot be modified by any person or entity, including, without limitation, any distributor or retailer of White Drive Products’ products. The obligation of White Drive Products under this Limited Warranty is limited to the repair or replacement of defective product(s) for which White Drive Products issued a RGA number, at White Drive Products’ option, upon Customer’s return of such product(s) to White Drive Products’ factory in Hopkinsville, Kentucky, freight prepaid. White Drive Products’ obligation to repair or replace defective product(s) hereunder shall arise only if (a) White Drive Products’ technician determines by inspection that such product(s) are defective in material or workmanship, (b) White Drive Products has received written notification from the Customer of the defect within the warranted time period and (c) Customer has notified White Drive Products in writing of the defect immediately upon discovery thereof. This limited warranty further shall not apply to any product which has been repaired or altered in any way by any person or entity other than White Drive Products, nor shall it apply to any product which has been subject to misuse, improper operating conditions, faulty installations, negligence or accidents. All products repaired or replaced under warranty will carry the remainder of the warranty left on the original motor. All products serviced for fee or goodwill, but not warranted, will have a 90-day warranty that covers assembly only. The 90 days will begin on the date serviced at White Drive Products.

LIMITATION OF LIABILITY
Except as otherwise agreed herein, White Drive Products shall not be liable for special, incidental or consequential damages arising out of the use of, or inability to use, any product sold by White Drive Products, including, without limitation, damage or loss of other property or equipment, loss of profits or revenue, or claims of customers of customer for any such damage or loss. The remedies of Customer set forth herein are exclusive, and the liability of White Drive Products with respect to any contract, or anything done in connection therewith, such as the performance or breach thereof, or for the manufacture, sale, delivery, resale, installation or technical direction of installation, repair or use of any product sold by White Drive Products, whether in contract, in tort, under any warranty or otherwise, shall not, except as expressly provided herein, exceed the price of the product(s) or part(s) upon which such liability is based. The price for the product(s) sold by White Drive Products is the consideration given by White Drive Products in limiting its liability hereunder.
